Welcome to HaveYouScene (the "App"), developed and operated by Troopell LLC ("we," "our," or "us"). By using or accessing the App, you agree to comply with and be bound by the following Terms of Service (the "Agreement"). If you do not agree to these terms, please do not use the App.

1. Use of the App

1.1 Eligibility: You must be at least 16 years old to use the App. If you are under 18, you must have the consent of a parent or guardian to use the App.

1.2 License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for personal, non-commercial purposes in accordance with this Agreement.

1.3 Account Registration: Certain features of the App may require you to create an account. You agree to provide accurate and complete information when registering and to keep your account details up to date. You are responsible for maintaining the confidentiality of your account credentials.

2. Data Collection and Privacy

2.1 Data Collection: By using the App, you agree that we may collect and process data as described in our Privacy Policy. This may include data collected through third-party services such as Google Firebase, Algolia, TMDB API, and Google AdMob.

2.2 Firebase & Firestore: We use Firebase and Firestore to store and manage user data. Firebase provides real-time database services, user authentication, and cloud storage for app features. By using the App, you consent to the collection, storage, and use of data in accordance with Firebase's privacy practices. Please refer to Firebase's Privacy Policy for more information.

2.3 TMDB API: The App may integrate with the TMDB (The Movie Database) API to provide movie, TV show, and other entertainment-related content. TMDB collects data based on your interactions with their API. By using the App, you agree to comply with TMDB's terms of use, which can be found at TMDB Terms of Use.

2.4 Algolia API: We use Algolia's search API to provide fast and relevant search results within the App. Algolia may collect data related to your search activities. By using the App, you agree to Algolia's terms of service, which can be found at Algolia Terms of Service.

2.5 Google AdMob: The App uses Google AdMob to serve advertisements to users. Google AdMob may collect data related to your use of the App for advertising purposes. By using the App, you agree to the collection of data by Google AdMob for personalized advertisements. 2.6 Third-Party Services: The App may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or the availability of these third-party services.

3. Prohibited Conduct

You agree not to:

  • Use the App in any unlawful manner or in violation of any applicable laws or regulations.

  • Engage in any activity that could damage, disable, or impair the functionality of the App.

  • Attempt to access or interfere with any user accounts, systems, or data without authorization.

  • Use the App for any commercial purposes without our explicit consent.

  • Violate any terms of service of the third-party services integrated into the App, including Firebase, TMDB, Algolia, or AdMob.

4. Intellectual Property

4.1 App Content: All content, features, and functionality within the App, including but not limited to text, graphics, logos, images, and software, are the property of Troopell LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.

4.2 Third-Party Content: The App uses third-party services (Firebase, TMDB, Algolia, and AdMob) that may provide content such as movie data, search results, and advertisements. All such third-party content remains the property of their respective owners and is used under the terms provided by those third parties.

5. Disclaimers and Limitation of Liability

5.1 No Warranty: The App is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

5.2 Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. In no event shall our liability exceed the amount you have paid, if any, for accessing the App in the six (6) months preceding the event giving rise to the claim.

6. Term and Termination

6.1 Term: This Agreement will remain in effect as long as you continue to use the App.

6.2 Termination: We reserve the right to suspend or terminate your access to the App at any time, without notice, if we believe you have violated any of these terms.

7. Changes to Terms of Service

We may update or modify these Terms of Service at any time. When we make changes, we will post the updated terms in the App and update the "Last Updated" date at the top of this page. You are encouraged to review the terms periodically. Continued use of the App after any such changes constitutes your acceptance of the new terms.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles.
